Bison Brush LLC – Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between you ("you" or "User") and Bison Brush LLC ("we," "us," or "our") governing your download, installation, or use of any Bison Brush iOS application, including Math Sheet Prints (collectively, the "Apps"). By accessing or using the Apps, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Apps.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps on Apple-branded devices that you own or control, solely for personal, non-commercial purposes and in accordance with these Terms and the Apple App Store Terms of Service. All rights not expressly granted are reserved by Bison Brush LLC.

2. Description of Service

The Apps provide various mobile application features and functionality as described in each individual App on the Apple App Store. Features and functionality may evolve over time as we release updates.

3. Eligibility & User Accounts

• Age requirement. You must be at least 13 years old or have verifiable parental/guardian consent to create an account or submit personal information. We do not knowingly collect data from children under 13 without such consent, in compliance with the U.S. Children's Online Privacy Protection Act (COPPA).
• Account responsibility. If an account is required, you must: (a) provide accurate information, (b) maintain the confidentiality of your credentials, and (c) promptly notify us of unauthorized use. You are responsible for all activities under your account.

4. Acceptable Use

You agree not to:

1. Violate any applicable law or regulation;
2. Access or attempt to access non-public areas of the Apps or our systems;
3. Interfere with, disable, or disrupt the Apps, servers, or networks;
4. Upload or transmit viruses, malware, or harmful code;
5. Reverse-engineer, decompile, or disassemble any part of the Apps;
6. Use the Apps for commercial purposes without our written consent;
7. Infringe the intellectual-property or privacy rights of others.

5. User Content & Ownership

You own any content, data, or materials you create with the Apps ("User Content"). You grant Bison Brush LLC a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content solely as needed to operate and improve the Apps and to honor settings you select when sharing or exporting. You represent that you have all rights necessary to grant this license.

6. Intellectual Property

The Apps and all original content, features, and functionality are and will remain the exclusive property of Bison Brush LLC and are protected by U.S. and international copyright, trademark, patent, and trade-secret laws.

7. In-App Purchases, Subscriptions & Refunds

Payments, subscriptions, or one-time purchases (if any) are processed by Apple. Apple handles all billing questions, cancellations, and refund requests in accordance with the App Store policies. We do not directly collect or store your payment information.

8. Privacy

Your use of the Apps is subject to our Privacy Policy, which explains how we collect, use, and safeguard your data.

9. Educational Accuracy Disclaimer

While we strive for accuracy, Bison Brush LLC does not warrant that all automatically generated questions, answers, or explanations are error-free. Always review worksheets and answer keys before classroom use.

10. Disclaimers of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BISON BRUSH LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE) ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY IN ANY MATTER ARISING OUT OF OR RELATED TO THE APPS OR THESE TERMS WILL NOT EXCEED US $100 OR THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE INCIDENT, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bison Brush LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising from: (a) your use of the Apps; (b) your violation of these Terms; or (c) your violation of any third-party right.

13. Updates & Modifications

We may deploy updates, upgrades, or new versions of the Apps and modify or discontinue features at any time. We may revise these Terms by posting an updated version in the App or on our website; continued use after the effective date constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Apps at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. Upon termination, the license granted in Section 1 ends immediately, and you must delete all copies of the Apps.

15. Governing Law

These Terms are governed by and construed under the laws of the State of Tennessee, U.S.A., without regard to conflict-of-law principles.

16. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
